For the past 24 years, Mr. Polinsky has engaged in all phases of construction litigation, arbitration, mediation and settlement, as lead, managing and co-counsel on multi-million dollar construction litigation, representing private and public entities, including the California Department of Water Resources, the California Department of Corrections, and the Los Angeles County Metropolitan Transit Authority. His cases have included large waterworks, power plants, correctional facilities, subway stations and tunnels, institutional and residential alterations and residential earthquake damage projects. Mr. Polinsky has handled matters in excess of $50 million and involving such topics as construction delay/acceleration; productivity; unilateral contract modifications; disputed extra work; disputed work costs; steel fabrication and placement; concrete quality and placement; manifold and penstock pipe fabrication and installation; changed site conditions; earthwork; construction defect; claims analysis; bid disputes; material non-disclosures; acceptability of work; adequacy of design documents and approvals; design/build issues; responsibilities of owners, contractors, designers, inspectors, subcontractors, fabricators, suppliers and vendors; quality control; listing and licensing issues; DBE; Buy America; contract interpretation; contractor termination; construction damages such as overheads, liquidated damages, cost of funds and interest; use of the Eichleay formula; California False Claim Act and Unfair Competition Law.
