Leaders Merchant Services, LLCWasserman, Comden & Casselman, LLP is investigating complaints from current and former employees of Leaders Merchant Services, LLC as part of an ongoing wage and hour class action. Plaintiff employees worked as non-exempt Sales Representatives for Camarillo-based Defendant Leaders Merchant Services and performed, among other activities, telephone sales of Defendant's electronic payment processing services and equipment to businesses. Defendant generally required new hires to work as hourly Trainee Sales Representatives for a "training period" that lasted up to 160 hours before classifying them as Sales Representatives. Plaintiffs allege that Leaders did not use this period to actually train workers, but instead to evaluate and "vet" new hires performing tasks identical to those of Sales Representatives while compensating them at sub-minimum wage trainee rates. Plaintiffs also allege that Leaders' "guaranteed draw" compensation structure did not conform to California's minimum wage laws and constituted unlawful business practices under the California Business and Professions Code. Plaintiffs allege also that Leaders frequently required them to work overtime without paying Plaintiffs overtime wages as required by the California Labor Code and the Fair Labor Standards Act (FLSA). |
