Class Action Lawsuit On Behalf of WinCo Truck Drivers for Unpaid and Missed Meal Breaks and Other Deceptive Practices Wasserman, Comden, Casselman & Esensten, L.L.P. and co-counsel Ackerman & Tilajef, P.C. are litigating a lawsuit on behalf of truck drivers previously or currently employed by WinCo Foods, LLC, regarding the company's alleged failure to provide timely off-duty meal periods to its California truck drivers; failure to pay its California truck drivers for missed, on-duty and untimely meal periods, failure to provide rest breaks, failure to pay wages for "on-call" time, failure to provide accurate itemized wage statements, failure to pay wages due at time of termination and other deceptive and fraudulent business practices. By law, employers in California must provide an off-duty 30 minute meal period to employees on or before the fifth and tenth hours of work. If an employer fails to provide the off-duty meal period, then the employer must pay the employee premium pay amounting to one hour of pay per day at the employee's regular rate of pay.
