Wage and Hour Class Action Lawsuit against Delano Farms, et al.
On July 17, 2009, Wasserman, Comden, Casselman & Esensten filed a federal class action lawsuit against Delano Farms Company, et al., on behalf of five agricultural workers, and a putative class of over 10,000 people (Eastern District of California Case No. 1:09-cv-01247-LJO-DLB). The lawsuit alleges that the defendants failed to pay wages for required pre- and post-shift work, and failed to provide adequate tools for class members or to reimburse class members when they purchased their own tools.
On April 19, 2011, Judge Lawrence J. O'Neill granted the plaintiffs' Motion for Class Certification. In confirming that WCC&E partner Gregory J. Ramirez would adequately represent the interests of the class, the Court stated: "[C]ounsel is an experienced wage and hour attorney with over 20 years litigation and class action experience and a member of the American Board of Trial Advocates." Attorneys Jessica Arciniega and James E. Perero are assisting Mr. Ramirez in the litigation, and contributed substantially to the successful Motion for Class Certification.
